These Terms of Service ("Terms") govern your access to and use of the KINUJO Philippines website and the purchase of KINUJO-branded hair care beauty devices and accessories ("Products") in accordance with Philippine consumer protection laws, including Republic Act No. 7394 (Consumer Act), Republic Act No. 8792 (E-Commerce Act), and Republic Act No. 10173 (Data Privacy Act).

1. ACCEPTANCE OF TERMS

By accessing or using this website (kinujo-ph.com) and purchasing Products, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the Republic of the Philippines. If you do not agree with these Terms, you must not use this website or purchase our Products.

2. LEGAL CAPACITY

To enter into a binding contract with us, you must be at least 18 years old and have the legal capacity to enter into contracts under Philippine law. By using this website, you represent and warrant that you meet these requirements.

3. MODIFICATIONS TO TERMS

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Changes will be effective immediately upon posting on this website. Your continued use of the website and services after any changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

4. DESCRIPTION OF SERVICES

KINUJO Philippines provides an online platform for the sale and distribution of authentic KINUJO-branded hair care beauty devices, including but not limited to hair dryers, hair straighteners, and related accessories. 
We also provide customer support, warranty services (applicable to Philippine-market products, Model: KHPH302), and product information.

5. ACCOUNT REGISTRATION AND SECURITY

5.1 Account Information

To place an order, you may be required to create an account and provide accurate, current, and complete information including your full name, email address, phone number, and delivery address in the Philippines.

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. ORDERS AND CONTRACTS

6.1 Order Process

When you place an order through our website, you are making an offer to purchase the Products. We will send you an email acknowledging receipt of your order. A binding contract is formed only when we send you a confirmation email accepting your order.

6.2 Right to Refuse Orders

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

6.3 Order Cancellation

You may cancel your order within 24 hours of placing it by contacting our customer service, provided that the order has not yet been shipped. Once the order has been shipped, cancellation is no longer possible.

7. PRICING AND PAYMENT

7.1 Pricing

All prices are listed in Philippine Peso (PHP) and include applicable Value-Added Tax (VAT) and import duties unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you place your order.

7.2 Payment Methods

We accept payment through PayPal. Payment must be received before shipment unless otherwise arranged.

7.3 Payment Security

All payment transactions are processed through secure, encrypted payment gateways in compliance with international payment security standards.

8. PRODUCTS AND DELIVERY

8.1 Product Descriptions

We make every effort to display our Products as accurately as possible. However, we do not guarantee that product images, descriptions, or specifications are error-free, complete, or current.

8.2 Delivery

Products will be delivered to the address you provide within the Philippines. Delivery times are estimated and not guaranteed.

9. IMPORT REGULATIONS AND TRANSFER FROM JAPAN

Products sold on this website may be imported from Japan or other countries and distributed in the Philippines. We handle all necessary import procedures, including customs clearance and compliance with Philippine import regulations. However, you are responsible for ensuring that the Products comply with any local requirements specific to your area.

Please note that some products available on this website are parallel import products — authentic KINUJO products originally manufactured for markets other than the Philippines. These products are sold at a different price point but are not covered by the KINUJO Philippines 1-Year Warranty. Only products manufactured for the Philippine market (Model: KHPH302) are covered by the warranty. Please check the product listing carefully before purchasing.

10. RETURNS AND REFUNDS

In compliance with Republic Act No. 7394 (Consumer Act of the Philippines), you may return Products within 7 days from receipt if they are defective, malfunctioning, damaged, or not as described. 

To be eligible for a return:

  • For defective or malfunctioning Products: Products may show evidence of minimal use necessary to identify the defect or malfunction, but must include all original accessories, components, and packaging materials
  • For other returns: Products must be completely unused and in original condition
  • All returns must be accompanied by proof of purchase

Refunds will be processed within 14 days of receiving the returned Product. Return shipping costs may be borne by the customer unless the return is due to our error or a defective or malfunctioning Product.

11. WARRANTY

KINUJO products manufactured for the Philippine market (Model: KHPH302) are covered by a 1-Year Warranty against defects and malfunctions in materials and workmanship from the date of purchase. Parallel import products — KINUJO products manufactured for markets other than the Philippines (i.e., models other than KHPH302) — are sold as-is and are not covered by this warranty, even when purchased through this website.

For defects or malfunctions discovered within 7 days of receipt, customers may choose either (a) return and refund under Section 10, or (b) warranty repair/replacement under this Section 11.

For defects or malfunctions discovered after 7 days from receipt, warranty service (repair or replacement) will be provided in accordance with the warranty card terms.

The warranty does not cover damage resulting from misuse, accidents, or unauthorized repairs. The warranty also does not apply to parallel import products (models other than KHPH302)

12. INTELLECTUAL PROPERTY RIGHTS

All content on this website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of KINUJO or its licensors and is protected by Philippine and international intellectual property laws, including Republic Act No. 8293 (Intellectual Property Code of the Philippines). The KINUJO trademark and logo are registered trademarks. You may not use, reproduce, distribute, or create derivative works from any content without our prior written permission. You are granted a limited, non-exclusive, non-transferable license to access and use this website for personal, non-commercial purposes only.

13. USER OBLIGATIONS AND PROHIBITED ACTIVITIES

You agree to use this website and purchase Products only for lawful purposes. You must not:

  • Provide false or misleading information
  • Use the website to engage in fraudulent activities
  • Resell Products for commercial purposes without our written consent
  • Attempt to gain unauthorized access to our systems
  • Interfere with the operation of the website
  • Violate any applicable Philippine laws or regulations

14.3 Child Safety

  • These devices are NOT TOYS
  • Keep out of reach of children
  • Adult supervision required at all times during use

14.4 Personal Use and Limitations

  • Intended for DOMESTIC HOUSEHOLD USE ONLY
  • Not for commercial or professional salon use
  • Do not use for purposes other than hair styling
  • Consult a physician before use if you have any medical conditions

14.5 Health and Safety Precautions

  • Do not use while bathing or in humid environments
  • Discontinue use if you experience discomfort, irritation, or allergic reactions
  • Not recommended for individuals with sensitive scalps or skin conditions
  • Keep away from water—risk of electric shock

14.6 Compliance with Product Manual

  • Read and follow all instructions in the user manual before use
  • Failure to follow safety instructions may result in injury, electric shock, burns, or device damage
  • Manufacturer and seller are not liable for injuries resulting from misuse or failure to follow instructions

14.7 No Liability for Misuse

By purchasing and using KINUJO Products, you acknowledge and accept all risks associated with their use. We expressly disclaim liability for any injuries, damages, or losses arising from:

  • Failure to follow safety instructions
  • Use by children without supervision
  • Voltage incompatibility
  • Misuse or improper handling

If you submit reviews, comments, or other content to our website, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content. TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless KINUJO Philippines, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your use of the website or Products
  • Your violation of any rights of third parties
  • Your violation of any applicable laws or regulations

19. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, pandemics, or disruptions in transportation or communication networks.

20. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

Any disputes arising out of or related to these Terms or your use of the website shall be resolved through:

1. Good Faith Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation.

2. Mediation: If negotiation fails, the parties may agree to mediation.

3. Litigation: If mediation is unsuccessful or not pursued, disputes shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

You agree to waive any right to a jury trial and to participate in class action lawsuits.

21. MISCELLANEOUS

These Terms, together with our Privacy Policy and any other legal notices published on this website, constitute the entire agreement between you and KINUJO Philippines.

21.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

21.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

21.5 Language

These Terms may be provided in English and other languages. In case of any conflict, the English version shall prevail.
